These terms govern your use of Hex Town, including all updates and features released with it. By installing or playing Hex Town you accept these terms. If you do not accept them, do not install or play the game.
Hex Town is published by Addison Yarborough, doing business as Nighttime Games, a sole proprietor based in the United States ("we", "us"). Our privacy policy forms part of these terms. Contact: hello@hextown.com. A postal address is available on request.
You must be at least 13 years old and, if you are under the age of majority where you live, have the agreement of a parent or guardian. Third-party services integrated with the game may impose their own age requirements.
Hex Town is licensed, not sold. Subject to these terms, we grant you a personal, non-exclusive, non-transferable, revocable license to install and play the game for your own non-commercial entertainment on the devices permitted by the store through which you obtained it.
All rights not expressly granted are reserved. The game and all its content, including code, art, audio, text and the Hex Town name and logo, remain the property of us or our licensors.
Hex Town is sold and distributed through Steam, operated by Valve Corporation. Purchase, payment and refund rights are governed by the Steam Subscriber Agreement and Valve's refund policy. We do not process payments or refunds.
A valid Steam account and the Steam client are required to install and run the game. Loss of access to your Steam account may result in loss of access to the game.
Multiplayer sessions are hosted by players rather than by servers operated by us, and are connected through Steam's networking services. The hosting player controls admission to and duration of a session.
Information associated with your platform account, including your display name and profile, is visible to other participants in a session. You control who may join through the game's multiplayer settings.
We do not monitor, moderate or record multiplayer sessions. Multiplayer functionality depends on third-party services and may be modified, interrupted or discontinued.
The game offers optional linking to a Discord account. Linking is initiated by you through Discord's own authorization process and may be revoked at any time in the game's settings or through your Discord account settings. The game is fully functional without it.
Your use of Steam, Discord and other third-party services is governed by their respective terms and privacy policies, including Discord's Terms of Service. We are not responsible for those services.
Saved games and settings are stored locally on your device and, where enabled, mirrored to your Steam account by Steam Cloud. Achievements and gameplay statistics are recorded to your Steam account by Valve. The game provides a function to delete all local data.
The game is under active development. Updates may alter game systems, and saved data created in one version may be incompatible with later versions. You are responsible for maintaining your own backups.
You may not:
Modification of your own copy for personal, offline use is not restricted by this section.
You may record, stream and publish video, screenshots and audio captured from the game, including on monetized channels, and may use the game's name and imagery to identify the content. You may not present such content as official or endorsed by us, or distribute the game's assets, soundtrack or cinematics as standalone files. This permission may be withdrawn from an individual for cause.
Suggestions, bug reports and other feedback you submit may be used by us without obligation of payment, attribution or confidentiality. You retain any rights you already held in the material submitted.
We may modify, add to, remove or discontinue features, and may cease distribution or support of the game. We do not warrant that the game or any feature will remain available indefinitely.
You may terminate these terms at any time by ceasing use of the game and uninstalling it. We may terminate them if you materially breach section 8 and fail to remedy the breach after notice. The reservation of rights in section 3 and sections 10 and 13 to 17 survive termination.
The game is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, and any warranty that the game will be uninterrupted, secure or error free.
Where applicable law does not permit such exclusions, they do not apply to you, and your statutory consumer rights are unaffected.
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of profits, data, saved games or goodwill. Our aggregate liability arising out of or relating to the game is limited to the amount you paid for it in the twelve months preceding the claim.
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be limited under applicable law.
We may amend these terms. The date above indicates the current version, and material changes will be identified on this page or in the game's release notes. Continued use of the game after an amendment takes effect constitutes acceptance of it.
These terms are governed by the laws of the State of North Carolina, United States, without regard to its conflict of law rules, and the courts of North Carolina shall have jurisdiction. If you are a consumer, this does not deprive you of the protection of mandatory provisions of the law of your country of residence, or of the right to bring proceedings there.
These terms and the privacy policy constitute the entire agreement between you and us regarding the game. If any provision is held unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of it. You may not assign your rights under these terms; we may assign ours in connection with a transfer of the game or the business.
